Flat Creek – A driver who was charged in a deadly December 6, 2019 accident on I-26 between the Flat Creek and Jupiter exits will have his first court appearance on February 7 in a Buncombe County courtroom according to a document obtained from the Buncombe County Clerk of Courts. One problem, he died in December.
Vincent Joseph Capizzi, 67, of Sugar Maple Drive in Mills River, was charged in the deadly accident that killed Nancy Louise Swann, 60, of Spruce Pine who died at the scene of the accident while her passenger a 17-year-old juvenile, also of Spruce Pine, was treated and released from Mission Hospital. The Tribune reported the incident last month after speaking to NC Highway Patrol Seargent Hugh Feinberg. Capizzi was charged with careless and wreckless [driving], misdemeanor death by motor vehicle and driving the wrong way on a dual lane highway, but at the time of the Tribune’s first report, Capizzi was still hospitalized.
He apparently succumbed to his injuries as there is a death certificate on file with the Buncombe County Register of Deeds Office as seen by this photo below of a search for a death certificate. However, no one has told the Buncombe County Clerk of Courts Office who gave information the Tribune that Capizzi still had a court date on Friday, February 7. This lead the Tribune to incorrectly report that Capizzi would be having his first court appearance on that date.
